Terms of Service

I don't currently sell a subscription directly. These terms cover paid products when they launch.
These terms apply when you use this website or buy software or a subscription from me. "I", "me" and "my" mean Saurabh Upadhyay, an individual sole proprietor based in Mumbai, India. "You" means the person or organisation using or buying. By buying or using what I sell, you agree to these terms.
1. What I sell
I sell digital software products and software-as-a-service (SaaS) subscriptions, such as paid plans for apps and developer tools listed on this site. Everything I sell is delivered electronically. There are no physical goods.
The price, billing period and what's included are shown at the point of purchase. Prices are in the currency shown at checkout, and applicable taxes are added as required by law.
Some of my software, such as the Guidester Flutter package, is also published free under an open-source licence. That code is governed by the licence in its repository, not by section 3 below.
2. Subscriptions and payment
- Subscriptions renew automatically at the end of each billing period until you cancel.
- You can cancel at any time. Cancellation stops the next renewal; you keep access until the end of the period you've paid for.
- Payments are processed by a third-party payment provider. I do not see or store your full card or bank details.
- Some purchases may be processed by a third-party merchant of record, which is the seller for that transaction. Where that applies, it is shown at checkout.
- Purchases made through an app store, such as Google Play, are billed by that store, which is the seller for those transactions. That store's refund rules apply to them rather than mine.
- If I change the price of a subscription, I'll tell you by email before it applies to your next renewal.

3. Licence
When you pay, I grant you a limited, non-exclusive, non-transferable, revocable licence to use the software or service for your own personal or internal business purposes, for the duration of your subscription or the term stated at purchase.
I keep all rights, title and intellectual property in the software. The licence does not let you resell, sublicense, rent or redistribute the software, or offer it to others as a service.
4. Acceptable use
You agree not to:
- use the software or service for anything unlawful, or to store or send unlawful, infringing or harmful content;
- try to gain unauthorised access to the service, other users' data, or the systems it runs on;
- reverse-engineer, decompile or bypass licence checks or usage limits, except where the law allows it;
- interfere with or overload the service, including through automated scraping or denial-of-service activity;
- share your account or licence key with people who haven't paid for it.
If you break these rules, I may suspend or end your access. Where the breach is serious or deliberate, I won't refund the unused period.
5. Your account and data
You're responsible for keeping your login details safe and for what happens under your account. You own the data you put into the service. How I handle personal data is described in my Privacy Policy.
6. Availability and changes
I work to keep the service running and fix problems promptly, but I can't promise it will be uninterrupted or error-free. I may update or change features. If I discontinue a paid service, I'll give reasonable notice and refund any prepaid period you can no longer use.
7. Disclaimer
Except as stated in these terms, the software and service are provided "as is" and "as available", without warranties of any kind, to the extent the law allows.
8. Limitation of liability
To the extent the law allows, I am not liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue, data or goodwill, arising from your use of, or inability to use, the software or service.
My total liability to you for any claim related to these terms or what I sell is limited to the amount you paid me in the 12 months before the claim arose.
Nothing in these terms limits liability that cannot be limited under Indian law, including under the Consumer Protection Act, 2019.
9. Ending the agreement
You can stop using the service and cancel at any time. I may end or suspend your access if you breach these terms. Sections 3 (ownership), 7, 8 and 10 continue to apply after the agreement ends.
10. Governing law and jurisdiction
These terms are governed by the laws of India. Any dispute arising from them is subject to the exclusive jurisdiction of the courts at Mumbai, Maharashtra.
11. Changes to these terms
I may update these terms. The date at the top shows the latest version. If a change materially affects paying customers, I'll notify them by email before it takes effect.
